These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and PROBOX Infotech Private Limited (“Carevie”, “we”, “our”, “us”), a company incorporated under the Companies Act, 2013, with its registered office at [REGISTERED OFFICE ADDRESS], India. These Terms govern your access to and use of the Carevie website, Android application, and any related online services (collectively, the “Services” or “Platform”).
These Terms are published in compliance with the provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and constitute an electronic record in terms of the Information Technology Act, 2000. No physical or digital signature is required.
By accessing, registering on, or using the Services in any manner, you confirm that you have read, understood, and irrevocably agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Health Data Privacy & Medical Disclaimer, each of which is incorporated by reference into these Terms. If you do not agree to any part of these Terms, you must immediately discontinue use of the Services.
The Services are intended only for Users who are:
• Eighteen (18) years of age or older;
• Capable of entering into a binding contract under the Indian Contract Act, 1872 (i.e., not a person disqualified by law); and
• Located in India.
By using the Services, you represent and warrant that you meet each of the above eligibility criteria. We reserve the right to terminate your account if we discover that you do not.
Carevie is a personal health information management platform that enables Users to:
• Store and organise their medical records and health-related documents in a personal Vault (such as lab reports, prescriptions, bills, insurance documents, and appointment information);
• Selectively share records with family members, caregivers, and other trusted contacts through the CareCircle feature, or through tokenised share links with parties who do not have a Carevie account;
• Use AI-powered features to summarise reports, explain conditions, extract structured information from prescriptions, and interact with the Carevie AI chat / FAQ assistant (see Section 9); and
• Receive service-related notifications, including push notifications on the mobile application.
Medical disclaimer
Carevie is not a hospital, clinic, telemedicine provider, healthcare professional, or emergency service. The Services do not provide medical advice, diagnosis, prescription, or treatment. Any content available on, or generated by, the Platform — including AI summaries — is for informational and organisational purposes only and is not a substitute for professional medical advice. Always consult a qualified and registered healthcare professional for any medical concerns.If you believe you are experiencing a medical emergency, contact emergency services (such as 112, 102, or 108 in India) or visit the nearest hospital immediately.
To access the Services, you must register an account by providing your mobile phone number and completing one-time password (OTP) verification through our authentication service provider, 2Factor. You may also be asked to provide additional information during onboarding (such as name, date of birth, gender, address, and blood-group verification document).
You agree to:
• Provide accurate, current, and complete information during registration and to update such information promptly when it changes;
• Maintain the confidentiality of any credentials, OTPs, and access tokens associated with your account;
• Be solely responsible for all activities that occur under your account, whether or not authorised by you; and
• Notify us immediately at support@carevie.in of any unauthorised access or use of your account, or any other breach of security.
We are not liable for any loss or damage arising from your failure to comply with these account-security obligations.
Service communications and push notifications: By creating an account, you consent to receive service-related communications from us — including OTPs, security alerts, sharing notifications, grievance acknowledgements, and other operational messages — via SMS, email, and (on the mobile application) push notifications. These communications are necessary for the operation of your account and cannot be opted out of while the account is active, except that you may disable push notifications at any time through your device or browser settings.
The CareCircle feature allows you to share specific records and information from your account with selected family members, caregivers, or other contacts (“CareCircle Members”). In addition, the Platform may allow you to generate a tokenised share link (“Share Link”) that grants access to specific records or a specific profile to any person who possesses the link — including persons who do not have a Carevie account.
By inviting a CareCircle Member, sharing content with them, or generating a Share Link, you represent and warrant that:
• You have obtained the necessary consent and authority to share the relevant information with that person;
• You will not use these features to share information about an individual who has not consented to such sharing, except where lawful (for example, in respect of your minor child);
• You will distribute any Share Link only to the intended recipient and through a reasonably secure channel, acknowledging that anyone who possesses the link may access the content it points to until the link is revoked or expires;
• You are solely responsible for the consequences of your sharing decisions; and
• PROBOX Infotech Private Limited is not responsible for the manner in which any CareCircle Member or Share Link recipient uses, stores, or further discloses the information you have chosen to share with them.
You may revoke a CareCircle Member's access or a Share Link at any time through the Platform. However, content that has already been viewed or downloaded by a recipient prior to revocation may not be recoverable, and we are not liable for such residual access.
A registered adult User who is the parent or lawful guardian of a Child (i.e., an individual under 18) may create a Child Profile under their own account to store and manage health records for that Child. By creating a Child Profile, you represent and warrant that:
• You are the biological parent or lawful guardian of the Child;
• You have the authority to provide consent under Section 9 of the Digital Personal Data Protection Act, 2023, for the processing of the Child's personal data; and
• You will use the Child Profile solely for the purpose of organising and managing the Child's health records, and not for any purpose that could be detrimental to the well-being of the Child.
You agree to delete the Child Profile (or, where appropriate, transition it into the Child's own account) when the Child attains the age of majority.
“Your Content” means any information, documents, images, photographs, files, text, prescriptions, reports, identification documents, and any other material you upload, enter, submit, or otherwise make available through the Services.
You retain all ownership rights in Your Content. You hereby grant PROBOX Infotech Private Limited a worldwide, non-exclusive, royalty-free, fully paid-up, sub-licensable (only to our service providers acting on our behalf), and revocable licence to host, store, transmit, process, display, and analyse Your Content, solely:
• To provide, maintain, secure, and operate the Services;
• To process Your Content through our AI service providers (OpenAI and Google Gemini) for the purpose of generating summaries, explanations, and structured extracts where you choose to use such features; and
• To comply with applicable law or a lawful order or request.
You represent and warrant that:
• You own Your Content or have all necessary rights and consents to upload and share it;
• Your Content does not infringe any intellectual property, privacy, publicity, or other right of any third party; and
• Your Content does not contain any unlawful, defamatory, obscene, or otherwise objectionable material.
Backup notice: While we take reasonable steps to protect Your Content, the Services are not a substitute for your own backups. We strongly recommend that you maintain independent copies of important medical records.
You agree not to use the Services in any manner that:
• Violates any applicable Indian law, statute, regulation, ordinance, court order, or governmental directive;
• Uploads, transmits, or stores any content that belongs to another person and to which you do not have the right;
• Uploads, transmits, or stores any content that is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, or relates to or encourages money laundering or gambling;
• Uploads, transmits, or stores any content that is harmful to a Child;
• Uploads, transmits, or stores any content that impersonates another person or knowingly contains false or misleading information;
• Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents the investigation of any offence, or is insulting to any foreign State;
• Uploads software viruses, trojans, ransomware, or any other malicious code;
• Attempts to gain unauthorised access to any portion of the Services, the accounts of other Users, or to our infrastructure or systems;
• Reverse-engineers, decompiles, disassembles, or otherwise attempts to derive the source code of any part of the Services, except to the extent expressly permitted by applicable law;
• Scrapes, crawls, or otherwise extracts data from the Services through automated means without our prior written consent;
• Uses the Services to build, train, or improve any competing product or service, or any machine learning or artificial intelligence model;
• Resells, sublicenses, or otherwise commercially exploits the Services without our prior written consent;
• Uses the Services to provide medical advice or diagnoses to other persons, hold yourself out as a medical professional, or otherwise practise medicine through the Platform;
• Harasses, abuses, threatens, intimidates, or stalks any other User or person; or
• Interferes with or disrupts the Services or the servers and networks connected to the Services.
Violation of this Section 8 may result in immediate suspension or termination of your account and reporting to applicable law enforcement or regulatory authorities.
Certain features of the Services use third-party AI service providers — currently OpenAI and Google Gemini — to:
• Generate summaries and explanations of medical reports and health conditions from documents you upload;
• Extract structured information from prescriptions you upload (for example, to auto-populate medication fields); and
• Operate the Carevie AI chat / FAQ assistant, which answers questions about the Platform and your records.
By using any of these features, you acknowledge and agree that:
• AI outputs (including chat responses) are generated through automated systems and may be incomplete, inaccurate, outdated, or misleading;
• AI outputs are informational only and are not medical advice, diagnosis, or treatment recommendations;
• You must not rely solely on AI outputs to make any decision regarding your health, medication, or treatment;
• The chat assistant is not a substitute for emergency services, a healthcare professional, or qualified support; and
• Document content, queries, and limited contextual data you submit through these features are transmitted to the relevant AI provider for processing, as described in our Privacy Policy.
PROBOX Infotech Private Limited disclaims all liability for any decision or action you (or any person relying on your account) takes based on AI outputs.
If you become aware of any content on the Services that you believe violates these Terms or any applicable law, you may report it to us in writing at support@carevie.in with sufficient particulars to identify the content. Upon receipt of a valid complaint, we will acknowledge it within forty-eight (48) hours and, where appropriate, take action within fifteen (15) days, in accordance with the IT Rules 2021.
All rights, title, and interest in and to the Services (excluding Your Content), including all associated software, source code, designs, user interfaces, graphics, text, trademarks (including the Carevie name and logo), service marks, trade names, and trade dress, are and shall remain the exclusive property of PROBOX Infotech Private Limited or its licensors, and are protected by Indian and international laws relating to copyright, trademark, patent, and trade secret.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services for your personal, non-commercial use. No other rights are granted to you, by implication, estoppel, or otherwise.
The Services may rely on, integrate with, or link to third-party services, websites, or resources (including OpenAI, Google Gemini, Google Analytics, 2Factor, Supabase, DigitalOcean, and Upstash). We do not control, endorse, or assume responsibility for the content, policies, or practices of any third-party service. Your use of any third-party service is governed by the terms and policies of that third party, and is at your own risk.
The Services are currently offered free of charge. We reserve the right to introduce paid features, subscriptions, or other monetised offerings in the future, in which case we will publish the relevant pricing, refund, and cancellation terms before such features become available, and require your separate consent to the applicable payment terms.
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may also update these Terms from time to time. Where changes are material, we will provide reasonable advance notice through the Platform or by other reasonable means. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the revised Terms.
You may terminate your account at any time by deleting it from within the Platform (Settings → Delete Account) or by emailing us at support@carevie.in. When you delete your account, it enters a 30-day recovery window during which you may restore it by logging in with your registered mobile number and OTP and clicking the “Restore Account” button. At the end of the recovery window, your personal and health data is permanently deleted, subject to the limited residual retention described in our Privacy Policy.
We may suspend or terminate your access to the Services (in whole or in part), with or without notice, if:
• You breach these Terms or any applicable law;
• Your account is involved in fraudulent, abusive, or unlawful activity;
• We are required to do so by law, court order, or governmental directive; or
• We discontinue the Services in whole or in part.
Upon termination of your account, your right to access and use the Services ceases immediately. Your content will be handled in accordance with the data-deletion provisions of our Privacy Policy. Sections that by their nature should survive termination (including Sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive.
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Without limiting the foregoing, PROBOX Infotech Private Limited does not warrant that the Services will be uninterrupted, secure, error-free, free from viruses or other harmful components, or that any defects will be corrected. We do not warrant the accuracy, completeness, reliability, or timeliness of any AI output, summary, extracted data, or other content provided through the Services. Your reliance on any such content is solely at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROBOX INFOTECH PRIVATE LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING (WITHOUT LIMITATION) LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR HEALTH OUTCOMES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by applicable law, our aggregate liability arising out of or in connection with these Terms or the Services shall not exceed the greater of: (a) the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim; or (b) Indian Rupees One Thousand (INR 1,000).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud or gross negligence).
You agree to defend, indemnify, and hold harmless PROBOX Infotech Private Limited and its directors, officers, employees, agents, affiliates, and licensors from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
• Your breach of these Terms or any representation or warranty made by you;
• Your use or misuse of the Services;
• Your Content, including any infringement or alleged infringement of any third-party right;
• Your sharing of information through CareCircle or otherwise; or
• Your violation of any applicable law or third-party right.
PROBOX Infotech Private Limited shall not be liable for any failure or delay in the performance of any of its obligations under these Terms caused by events beyond its reasonable control, including (without limitation) acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil disturbance, governmental action, internet or telecommunications failures, or third-party service provider outages.
These Terms, and any dispute or claim arising out of or in connection with these Terms or the Services, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
Subject to the dispute-resolution mechanism below, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms.
Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or invalidity thereof, that cannot be resolved amicably within thirty (30) days of written notice from one party to the other, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties (or, failing such agreement, by the procedure set out in the said Act). The seat and venue of arbitration shall be Mumbai, Maharashtra, and the language of the arbitration shall be English. The arbitral award shall be final and binding on the parties.

The Grievance Officer will acknowledge receipt of any complaint within forty-eight (48) hours and endeavour to resolve it within fifteen (15) days of receipt.
• Entire agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Health Data Privacy & Medical Disclaimer, constitute the entire agreement between you and PROBOX Infotech Private Limited regarding the Services and supersede all prior or contemporaneous understandings.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• No waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms (in whole or in part) without our prior written consent. We may freely assign or transfer these Terms to any successor or affiliate.
• Notices: Notices to us must be sent in writing to the email addresses set out in these Terms. Notices to you may be sent to the email or mobile number associated with your account.
• Language: These Terms are drawn up in the English language. In the event of any translation, the English version shall prevail.
